1. Acceptance of Terms
By creating an account or using Pakstoor, you agree to be bound by the Terms of Service, the Privacy Policy, the Protected Dispute Review & Return Rules, and all applicable South African law, including the Consumer Protection Act (CPA) and Electronic Communications and Transactions Act (ECTA).
2. Eligibility
You must be at least 18 years of age and a South African resident with a valid South African ID to use Pakstoor. Identity verification is required after your first sale.
3. Listings and Sales
Sellers are responsible for the accuracy of listings. Prohibited items include firearms, alcohol, tobacco, counterfeit goods, stolen property, live animals, and items that violate any South African law. Pakstoor reserves the right to remove any listing at its sole discretion.
4. Protected Transaction Review
Funds are held by Pakstoor's regulated escrow partner during delivery and inspection. After courier-confirmed delivery, the buyer has the applicable inspection window shown on the deal to inspect the item and open a Protected Review if the item is damaged, missing, or materially not as described. If a Protected Review is opened within that window, release is paused while Pakstoor reviews the case. If no Protected Review is opened, Pakstoor may instruct the escrow partner to release the funds to the seller. Refunds, payouts, return-courier handling, and other outcomes are processed in accordance with applicable law and the rules of our escrow provider. 5. Courier and Delivery
At launch, all items ship via The Courier Guy. In-person collection is not permitted. Seller is responsible for drop-off; buyer is responsible for providing a correct delivery address or pickup point.
6. Fees
Pakstoor charges a Secure Transaction Fee on successful sales — covering escrow facilitation, courier control and fraud protection. The exact rate is disclosed before listing. Courier costs are quoted at checkout and paid by the buyer unless otherwise agreed.
7. Account Suspension
We may suspend or terminate accounts that violate these Terms, engage in fraud, or receive repeated buyer complaints. Suspended users forfeit access to pending funds until resolution.
8. Limitation of Liability
Pakstoor is a platform, not a party to transactions. We facilitate payment and courier but do not warrant the condition, authenticity, or legality of listed items beyond our moderation efforts.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email at least 14 days before taking effect.

Pakstoor (Pty) Ltd is the Responsible Party for personal information collected through this platform. We comply with the Protection of Personal Information Act (POPIA), Act 4 of 2013.
1. Information We Collect
Account data: name, email, mobile number, South African ID (for verified users). Transaction data: items listed, offers made, conversations with counterparties. Technical data: IP address, browser fingerprint, device info for fraud detection.
2. Why We Collect It
To operate the marketplace, verify identity, process payments, prevent fraud, comply with law, and improve the service. We do not sell your data. We do not use your data for third-party advertising.
3. Sharing With Third Parties
Data shared only as needed: courier partners (delivery address), payment processors (transaction data), verification providers (ID check), and law enforcement when legally compelled.
4. Data Retention
Account data: retained while account is active, plus 5 years (required by FICA). Transaction records: 7 years (tax law). Chat messages: 2 years. You may request earlier deletion where legally permitted.
5. Your Rights (POPIA Section 23–25)
You may: access a copy of the data we hold on you; correct inaccurate data; request deletion (subject to legal retention); object to specific processing; lodge a complaint with the Information Regulator.
6. Security
Passwords are hashed with Argon2id. Session cookies are httpOnly and encrypted. ID documents are encrypted at rest. We conduct regular security audits.
7. Cookies
We use strictly-necessary cookies for authentication and a minimal analytics cookie for service improvement. No third-party advertising cookies are set.
8. Data Breach Notification
In the event of a data breach likely to affect you, we will notify you and the Information Regulator within 72 hours, as required by POPIA Section 22.

Send a written request to privacy@pakstoor.co.za. Include your full name, the email address on your account, the specific right you are exercising, and any supporting details. We respond within 30 days as required by POPIA.
4. Data Breach Notification
Under POPIA Section 22, if we reasonably believe personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator within 72 hours of becoming aware.

How does Protected Transaction Review work?

How do I sell an item?
Click "Sell an item" from any page. Photos, price, and a short description take about 5 minutes. Pick a courier (Courier Guy, Aramex, Pargo, or Fastway) and your item goes live.
What can't I sell on Pakstoor?
Firearms, alcohol, tobacco, counterfeit goods, live animals, or anything that can't legally be shipped by a registered South African courier. Listings that break these rules are removed and repeat offenders lose their account.
Why do you need my ID?
FICA (Financial Intelligence Centre Act) requires us to verify identity for anyone receiving marketplace payouts. Buyers don't need to verify: only sellers do, and only after their first successful sale.
My item arrived damaged. What now?
Take photos immediately, including the parcel, waybill, packaging, and item damage. Do not accept the item if there is a serious issue. Open a Protected Review from the deal page before the applicable inspection window shown on the deal expires.

The Pakstoor platform, including its design, code, interface, branding, and original content, is the intellectual property of Pakstoor (Pty) Ltd, a company registered in the Republic of South Africa.
1. Platform Ownership
All software, source code, database schemas, UI designs, wireframes, icons, illustrations, and interactive elements that make up the Pakstoor platform are owned by Pakstoor (Pty) Ltd or its licensors. These works are protected by the Copyright Act 98 of 1978 and applicable international treaties.
2. Trademarks
"Pakstoor", the Pakstoor wordmark, the hexagonal "P" logo, and associated brand assets are unregistered trademarks of Pakstoor (Pty) Ltd. Unauthorised use, reproduction, or imitation of these marks in any commercial context is prohibited.
3. User-Contributed Content
Listings, photographs, descriptions, messages, and reviews posted by users remain the property of their authors. By uploading content to Pakstoor, users grant Pakstoor (Pty) Ltd a non-exclusive, royalty-free licence to display, store, and distribute that content for the purpose of operating the platform. This licence terminates when the user deletes the content, subject to backup retention periods.
4. Third-Party Assets
Pakstoor uses third-party libraries, fonts, and services under their respective licences. Notable attributions include: Oswald and Inter (Google Fonts, SIL Open Font Licence), JetBrains Mono (SIL OFL), Feather Icons (MIT), and various open-source JavaScript libraries credited in our source repositories.
5. Permitted Use
You may browse, view, and interact with the platform for personal, non-commercial purposes consistent with our Terms of Service. You may take screenshots for personal record-keeping or dispute evidence. You may not scrape, mirror, reverse-engineer, or republish platform content without written permission.
6. Prohibited Use
The following are strictly prohibited without written consent: copying the platform's design or code to build a competing service; using Pakstoor branding in your own marketing; bulk-downloading listings or user data; training AI models on platform content; creating derivative works of Pakstoor's proprietary assets.
7. Reporting Infringement
If you believe your copyrighted work has been posted on Pakstoor without authorisation, send a takedown notice to legal@pakstoor.co.za with: (a) identification of the copyrighted work; (b) the URL of the infringing listing; (c) your contact details; (d) a signed statement under oath that the claim is accurate. We process valid notices within 48 business hours.
